

Our Extended Policy
MACdesigns – Website Design Contract
This agreement outlines the terms, responsibilities, and expectations for website design services provided by MACdesigns (“Designer”) to the Client. By initiating work with MACdesigns, the Client acknowledges and agrees to the terms below.

1. Scope of Work
This agreement covers website design services as outlined in the approved proposal or quote. Any additional pages, features, revisions, or deliverables beyond the agreed-upon scope will require a new quote or an amendment to this contract.

2. Deliverables
Deliverables for this project include:
Website layout design
Homepage and primary landing page design
UI elements and design components
Brand assets if applicable
Export-ready files such as PNG, JPEG, SVG, and templates (including Canva templates where relevant)
Deliverables will be provided after all outstanding invoices are paid in full.

3. Ownership & Usage Rights
3.1 Ownership
a. All creative works, sketches, concepts, initial drafts, and unused ideas remain the property of MACdesigns.
b. Editable source files (such as PSD, AI, or Figma files) are not included unless explicitly stated in writing and may incur an additional fee.
c. The Client does not hold ownership rights to unchosen or unused design concepts.
3.2 Usage Rights
a. Upon full payment, the Client receives a non-exclusive, non-transferable license to use the final approved design(s) for the intended purposes outlined in the project scope.
b. The Client may use the finalized design(s) for personal or commercial use within the agreed-upon scope.
c. MACdesigns retains the right to showcase completed projects in portfolios, websites, and promotional materials unless the Client requests otherwise in writing.
3.3 Prohibited Use
The Client may not alter, modify, reproduce, distribute, or resell any design work without written permission from MACdesigns.
3.4 Confidentiality
Both parties agree to keep all project details, content, proprietary information, and communication confidential.
3.5 Copyright & Trademark
MACdesigns guarantees that all original work is not knowingly infringing on any existing intellectual property. The Client is responsible for ensuring that all content they provide is legally owned or licensed.

4. Client Responsibilities
To maintain timelines and productivity, the Client is responsible for:
Providing all text, images, login credentials, and required content
Ensuring submitted content is proofread and accurate
Delivering feedback within agreed-upon timelines
Responding professionally and respectfully throughout the project
MACdesigns is not responsible for delays caused by missing or incomplete content.

5. Timeline & Communication
5.1 Timelines
Estimated timelines are based on the Client providing feedback within 48 hours, unless otherwise agreed. Delays in communication or content submission may extend the project timeline.
5.2 Communication
All project communication will take place via email or an agreed-upon platform. MACdesigns aims to respond within 1–2 business days.

6. Revisions Policy
MACdesigns offers:
Up to three revision rounds per project phase
Revisions must be clearly communicated in detail
Additional revisions beyond the included three will be billed at $75 per hour
Timely feedback is required to prevent timeline extensions. Final approval will be required at the end of the last revision round.

7. Payment Terms
7.1 Deposit
A 50 percent deposit is required before work begins. Work will not start without the deposit.
7.2 Final Payment
The remaining balance is due upon project completion before any final files are released.
7.3 Payment Methods
Payments may be made via e-transfer, cash, or another agreed-upon payment method.
7.4 Refund Policy
All payments, including deposits, are non-refundable once work has begun.
7.5 Late Payments
A 2 percent per month late fee applies to invoices more than 6 days overdue.
Invoices are issued on the 1st of each month.
Work may be paused until outstanding payments are made.

8. Pause Clause
If the Client becomes unresponsive for 10 days or longer, the project will automatically enter a Pause Status.
A $100 restart fee will be required to resume work, and a new timeline will be established.

9. Termination
9.1 Termination by Client
The Client may terminate the project at any time with written notice.
The initial deposit is non-refundable and will be applied to hours already worked.
All outstanding fees must be paid within 3 days of termination.
9.2 Termination by MACdesigns
MACdesigns may terminate the project if:
The Client fails to provide required feedback or content
The Client exhibits disrespectful, harassing, or discriminatory behavior
The Client’s goals or values no longer align with those of MACdesigns
Payment deadlines are repeatedly ignored
Upon termination, the Client is responsible only for payment of work completed to date.
9.3 Handover Upon Termination
Completed work will be delivered after all outstanding payments have been made.
MACdesigns retains ownership of any incomplete designs, drafts, or concepts.

10. Liability
MACdesigns is not liable for:
Lost profits or revenue
Lost data
Website downtime
Hosting failures
Plugin or theme updates
Third-party service issues
Security breaches resulting from hosting or software
The Client is responsible for maintaining backups and securing their website after delivery.

11. File Storage & Archiving
Completed files are stored for 6 months after project completion. After this period, retrieval may not be possible.

12. Acceptance of Terms
By paying the deposit and initiating the project, the Client acknowledges that they have read, understood, and agree to all terms in this contract.
